fake mot





where would someone stand within the law if they bought a car and the mot certificate was fake?? would there be fines etc

please help as a friend might have bought one with a fake one

In sh*t probably.

Although if he believed it to be geniune, then it lies with the seller or the garage that issued it (depending on what you mean as a fake MOT).

Do you mean fake as printed off at home or fake as in car is not roadworthy?
 


fake as in looks roadworthy but the certificate looks to be made up as in the bit on the certificate that is raised as in the stamp is not raised if that makes sense

Depends if he knew about it or not. What car was it, and where was it bought from as he shouldnt really drive it until it passes a proper one?
 


There is a telephone number on the MOT certificate that you can call to check the Authenticity of the document... VOSA know exactly what serial numbers that test centres are issued with.. They are very very strict about this..

Yes the certificate should be watermarked. But as with our old MOT stamp it was in poor condition and it was very difficult to read and certainly the text did not stick up from the surface

Oh and ignorance is not Legal Defense unfortunately.. So if you arnt sure then get it checked..

If the car is in poor condition and the MOT is fairly recently you are well within your rights to get an Inspection done by VOSA.. If the car is in their eyes unroadworthy then they can prosecute the garage how origionally wrote the MOT..

BUT remember that the MOT is not a sign that the car is Roadworthy.. It has only passed the MOT test at the time it was presented.. It could still have faults that dont fail the MOT but will be an offence under "construction and Use" laws..
 


You can call the VOSA MOT line on 0845 600 5977 and they will be able to check it out for you. If its a dud Id take it up with the trader who sold the car and insist that they MOT it at whatever cost to them, (after all the price paid for the car was including valid MOT) if they refuse threaten them with the local trading standards dept!

Good point! As long as the trader is an MOT tester / testing station the VOSA threat will do the trick, if not then trading standards.........
