Complaints Against Ebay & Paypal

A number of recent posts would indicate that people are still falling foul of the complex procedures put in place by Ebay/Paypal to frustrate users with their legitimate complaints.

Ebay own Paypal. so don’t allow them to pass the buck back and forward.

Paypal are governed by the same rules that apply to Banks and Credit card issuers. They cannot legally avoid dealing with fraudulent transactions in which they have taken or received your money. NO MATTER HOW THIS WAS DONE. i.e. Hacking, postal losses, account hijacking etc.

This is not headlined and you need to drill down quite a long way to find it ( a deliberate ploy used by both organisations)

The important part is this :-

If you are still not satisfied and it appears the matter cannot be resolved satisfactorily, you may be able to refer your complaint to the Financial Ombudsman Service. This would depend on several factors, including the nature of the complaint. The Ombudsman Service exists to help resolve individual disputes between consumers and financial firms. Each case is considered impartially and on its own merits. A leaflet explaining the Financial Ombudsman Service is available on request. If you contact the FOS by phone and ask for the person who deals with Paypal complaints, you will find them very willing to help. They will give you a reference number and a date (4 weeks) by which time the matter must be resolved by Paypal.

If you pay your Paypal account by Credit card, you are further protected by the the Consumer Credit Act 1974 which gives a credit-card holder a claim against the card-issuer when the card is used to fund a payment through an electronic money institution – for example, Paypal, for a purchase through eBay – and the person ultimately receiving the payment .

If you have lost money or goods in a transaction on Ebay where you have paid by or offered payment via Paypal, they must deal with your complaint and they are liable.

DO NOT BE PUT OFF BY "STANDARD BUYER PROTECTION" SCHEMES AND OTHER PAYPAL "SO CALLED" POLICIES. THEY ARE NOT LAWFUL.
