No its by law she has to have them on especaily on a 40 road look in your highway code book as you should have one anyway...

M40 CUO - that's good news in a way, but she was facing in the same direction as us... I can only assume that my mate in front thought the Smart car was actually on the move.
Not having a dig pal but take this as a life/driving experience wether you were speeding or not. You nether know what is round the next blind bend.

im 17 and i know for a fact if i were out on that road i would be hammering it.

I drive down that road at least twice a day, there are quite often parked cars whilst travelling in the other direction but parked up on the pavement, so you can't be "hammering it" because you're constantly having to give way. However, those cars are parked legally and in clear view.

Highway code rule 249:

All vehicles MUST display parking lights when parked on a road or a lay-by on a road with a speed limit greater than 30 mph (48 km/h).

This is a 40mph limit, we have proof that not only was she not parked close enough to the side of the road (not sure if that's valid), and less than 10m from a junction, she did not have her parking lights on...

An expert who examines cases such as this one said to my friend on 206info that although he went into the back of me, he has a very valid case to make a claim against the woman...

I'm not sure if there are any experts on here, but from what i've shown on here we can make a claim against her?

Going to Mill Lane Renault Bodyshop in Aldershot tomorrow morning, will get the damage assessed and then go from there!

Quick question guys: To get the damage assessed should I drop it at the local garage or go to the nearest Renault dealer, or Renault bodyshop?

Am i missing something?

The google maps links gives me a view of what i can only tell is a flat straight bit of road in a village? The smart car was parked opposite the junction by the shingle driveway on the left?

So you stopped to give way behind the smart car and your mate drove into the back of you? How did he manage that when you can see for such a massive distance?

Maybe I am getting the wrong end of the stick... :/

Firstly, you have no proof. Unless there was video camera in your car. The lights being on/not being on, is a moot point. You can't prove it.

Your mate has absolutely zero chance of claiming against her. Zero. He hit you because he was going too fast and he was too close. It's 100% his fault. What if you replace that smart car with a child? A dog? The easter bunny? Who would you claim against then?

The lights on in a 40 limit is probably true but it's one of those obscure laws that nobody ever pays attention too. Like it's illegal to have an air freshener hanging from your mirror. Nobody does anything about it.

Just get your mate to pay for the damage himself. Going through insurance will increase both your premiums (I know it's not your fault, yours will still go up) and then he'll lose vs the woman anyway.

I wish people would just accept a bit of responsibility sometimes instead of trying to blame everyone else.

Yeh i'm pretty certain he has no claim against her, despite her terrible parking... Unfortunately it's just one of those things and life goes on... He'll learn :(

Just been to the Renault specialist bodyshop in Aldershot, the estimator had a quick look at it and said it'll probably cost about £2000 to fix as the boot floor is mashed... They have pictures and he will do a proper estimate on Monday and let me know...

I bought the car for £2100, so it's pretty bad.. :(

Btw, there was a sweet 182 cup parked outside the specialist, personalised plates, was very nice... not a member on here by any chance?
 
LOL at the talk of claims against the hoe. Just put it down to experience and move on. It could have been a bus, a Police car, a fire engine, a badger, a unicorn. It doesn't matter if her car was packed with explosives and the TomTom set for the houses of parliament. Completely moot. It's every driver's responsibility to make sure they can stop in the distance that they can see to be clear. Your mate wasn't in control of his car, and he crashed it. No one else to blame but himself. s**t happens. At least no one was hurt.

Oh and if you can't open the boot then I'm going with write-off :(

Rinse your mates insurace. Don't forget a hefty whiplash claim too. :)

Haha i don't have whiplash, and the rise in personal injury claims is the reason everyones premiums are up 50% - 100% from last year...

You lose out in the long run, you might get a few grand for a whiplash claim but i'll spend more than that on increased premiums in the next few years anyway.
 
There's no way your mate is going to cough up 2k to fix your car. So it's going to be written off.

However unfair it may seem, as others have said it's your mates fault by law. However shite women park these days, your mate should have had a safe enough distance to stop in time.

Pretty unlucky thing to happen so soon after passing.

Let your mate take the blame, then go and 'decorate' the bints car.

Any pics of the car? £2000 worth of damage seems a lot to say he was only going 10mph? If your lucky you could drop on a tailgate & rear bumper in the right colour, then just need to sort the boot floor out

Looks like so little, but there's a lot of damage around the edge of the spare wheel base on the floor of the boot

The only advice i can give u is.

  1. get the approx cost for you to buy a replacement car - easy approx 2k
  2. get your mate to get an online insurance quote with 1 FAULT claim on his record/approx costs etc - easy
  3. when the quoted price is over 2k more than he pays now if he has a claim he will pay up
  4. time to find out how much of a mate this guy is
 
I'm still shocked (I'm not really) that anyone could even entertain the idea of anyone else being to blame. It's a road. Things are on it. JLOL.
