Rejecting a duff car - where do i stand?

ok so most will have saw the thread about my 200, i bought it pre registered with 5 miles on the clock on the 30th of December, 2 months and 2500 miles later it suffered full engine failure, i gave the dealership a chance to rectify it, 2 weeks later it had a brand new engine, however the tracking was out and its been having difficulty selecting gears (likely going to be simply requiring adjustment to the gear linkage).

so its going back in to get looked at for the gearchange problem and im taking it to a suspension geometry specialist to have that sorted (i was planning on taking it there anyway at some point to have it checked out)

problem is 9/10 it selects gears properly, and its only ocassionally having issues with reverse, 3rd and 5th, so im not holding out massive hope on it being sorted!

the full experiance has put a downer on the car which has now been ripped apart and rebuilt and im considering looking at other options, either rejecting or a replacement. anyone got any experiance with this? where do i stand? how do i go about it?

ive had a look online but cant seem to find any black and white guidelines on where i stand or if i can even go down this path.

IMO you don't have a chance in rejecting it now. I wouldn't have let them put a new engine in the thing, i'd have demanded a new car.

Have you spoke to RUK customer services out of curiousity?

RUK arn't being much help either apart from getting me a curtisy car as the dealership couldnt.

just looking at other options as im going to loose a bit if i trade it in for something else.

Go to citzens advice on something of this scale rather than rely on help on forums, but IMHO you gave the seller the chance to rectify and they did so I think you have no chance now of rejecting at this stage.

most of the stuff i can find online is basically saying you can only reject it after giving the dealership 3 chances to rectify the problem, but thats about as much as i can find

Have you told them how you are feeling and what you want etc? They're normally really good, especially if you have a history with the brand.

I'd be back onto RUK about it. But really, your chance of rejecting it came and went with the new engine. :(

but the car is still causing issues so its kind of not 100% rectified?

if that makes sense

that was my way of looking at it, the sale of goods acts mentions you must give the seller 3 chances to rectify it within a resonable time scale before you can reject it, so id imagine engine change was 1, and then 2 chances to sort the linkage before rejection.

I think that's about right mate.

I would imagine engine change was 1 attempt at sorting engine problem
Gearbox fixing will then be 1 attempt at sorting that problem

Ie different problem, counter restarts, thats my understanding anyway.

I thought it was 3 times for the same thing?

Otherwise people who had warranty work for various different recalls or defects would always be rejecting cars.

but there isnt anything wrong with the physical gearbox its related to the same problem, gearbox was removed during engine change and not fitted/setup properly.

I think you are clutching at straws there.

They fixed one (major) problem, in doing so they have caused another (minor) problem, they will now be allowed to rectify that too.

I dont really think you stand a chance of rejecting a car in these days i tryed with my landrover,three years on Ive still got it. the 3 times the same problem is rubbish. they wont change it!

Would be pretty bloody gutted if I were you mate.

If you dont get anywhere just constantly take it back, be a needle in their side. Pick the silliest issues...

In 2003 we bought 5 new Scania units. Basically one of them, from the very beginning had issues... 70k later the engine went. Really strange, never had issues with any of the others. After alot of nagging we ended up with a brand new replacement unit courtesy of Scania GB

i can only echo whats been said

keep on for them to fix anything blag as much good will from ruk accessorys free services

your be even more upset once your see the part ex figures and throwing more money into another car keep it 12months and trade it in when its needing new tyres & brakes tax ;)

it hurts but its the best option the grass isnt always greener with another brand or car :(

This is now a second fault, within 6 months of ownership

Just state how you're losing faith in the car, they can insist on a repair but if it is going to be (reasonably) inconveneint or take (reasonably) too long, then you can demand a replacement or refund.

If they can't replace, they refund.

THis is from base-level Sale Of Goods Act though, there are areas regarding the sales of cars that will step in that I have no knoweldge of

Like said earlier of hey don't offer you a decent outcome then keep taking it back.. I'm sure given the chance they will fully sort the car...

My grandad had a brand new clio 1.2 and he only uses it for driving to a field to walk his dog and once a year to travel to Blackpool for a weekend break... 2500 miles down the line and the gearbox failed... It was taken by the AA to a Renault dealership where it was bought and they refused that it was the gear box.. 4 weeks later after trying numerous things they finally changed the gear box.. And it's been fine ever since.. They just needed a kicking to sort it..

thanks buddy, ill get the ball rolling in the morning see where we stand, they cant get it in for gear linkage fault for 2 weeks as they have no curtisy cars and need it for a few days (LOL! they get better every time)

Careful, time taken to examine the fault is seperate from the time taken to repair it.

It can take them 3 months to dianose the issue, but if it only takes a day to repair it, that's still a reasonable timeframe.

In all honesty, I'd say your best chance is to go for a replacement vehicle, but don't start pushing your luck by demanding "compensation" or "upgrades" on the new vehicle. If you want to start playing that game, go for some free servicing instead (2 years should suffice, eh?).

Even then, don't count on it, they only have to give you working goods, not bend over and give you the entire moon on a stick.

Don't think RUK will be able to help you TBH.

The only contract they hold with you is that of the warranty that they have honoured.

Your sales agreement is with the vendor of the car (Dealership) and as the car is a Pre-reg it will technically be classed as a used vehicle (therefore not within RUK remit).

My advice would be to have a civilised sit down meeting with the Dealer Principal and Sales Manager to discuss your options.

If you purchased on Finance it's also worthwhile bringing them into the discussion.
